[:en]Carrington Tours New Zealand Terms and Conditions and Privacy Policy

Tour price & confirmation: All pricing is quoted in New Zealand Dollars. New Zealand GST (Goods & Services Tax) of 15% is included in all tour costs and quotes. Quoted costs, specific accommodations and activities and times are subject to change and availability until a firm reservation is secured.

Confirmation:                On confirmation of a final itinerary or event, the client agrees to pay a 25% non-refundable booking fee. This will allow Carrington Tours New Zealand to make the necessary bookings for the itinerary to ensure firm bookings are held for the client and acknowledges your agreement to our terms and conditions. Terms of business are by prepayment of all tour costs.

Balance of fare:            The balance of tour price is due to Carrington Tours New Zealand 30 days before the tour starts. If the full tour price is not received by this date we reserve the right to cancel your tour and retain the deposit. Tour reservations can be made within 30 days provided full payment is made at time of booking.

We accept payment by Visa and MasterCard and use a secure automated service provided by ANZ eGate (Australia and New Zealand Banking Group Limited).

Cancellation Policy:    You may cancel your tour for any reason at any time, however please bear in mind our cancellation costs. Accommodation and other third party providers may have cancellation policies that impart fees for cancellations at any time. Particularly in peak time the need to fill rooms is paramount to individuals businesses and in many cases their livelihood. With this in mind please be aware that cancelling your tour or making major changes you may incur additional fees. As almost every property, activity and other business may have different rules and conditions please ask if you would like to be made aware of each of these for your tour prior to booking. Cancellation fees depend on when Carrington Tours New Zealand receives notification of a cancellation:

Bookings cancelled more than 30 days before departure date incur 25% of tour cost, plus any cancellation fees applied by other providers such as accommodation, service providers and other activities.

Bookings cancelled between 30 and 21 days before departure date incur 35% of tour cost, plus any cancellation fees applied by other providers such as accommodation, service providers and other activities.

Bookings cancelled between 21 and 7 days before departure date incur 50% of tour cost, plus any cancellation fees applied by other providers such as accommodation, service providers and other activities.

Bookings cancelled within 7 days before departure date are subject to 100% of tour cost, plus any cancellation fees applied by other providers such as accommodation, service providers and other activities.

No refunds will be made after travel has commenced.

Carrington Tours New Zealand has the right to cancel any arrangements and bookings made for the client if full payment is not received before the event or arrival in country and will treat the trip/event as a cancelled booking until full payment is received.

Booking and Tour payment:  During the holiday, Carrington Tours New Zealand understands that the client may choose to change parts of the itinerary due to weather or personal circumstances. In the event of cancellations, Carrington Tours New Zealand will use its influence to obtain refunds where pre-payment has been made. The client accepts that often cancellations will result in a 100% charge having been made especially in the case of cancelled accommodation bookings where this requirement is published by the provider. A post trip reconciliation of the clients account will be completed by Carrington Tours New Zealand, any money due for additional bookings of activities, accommodation and other services made in country will be paid by the client within 14 days of receipt of Carrington Tours New Zealand Invoice. Likewise, if the client made cancellations and Carrington Tours New Zealand were able to obtain refunds, Carrington Tours New Zealand will then make a refund payment to the client within 14 days of completion of the reconciliation of the account.

Should any amounts remain outstanding, and legal costs are incurred to recover the debt, then Carrington Tours New Zealand has the right to add the legal costs incurred to the outstanding debt and recover these as well from the client. Should it be necessary to take legal action against the client, the client accepts and abides by any court or legal ruling that is made under New Zealand jurisdiction. In addition, any fines, debts, and/or legal costs incurred by the client while in the country for any infringements made are the sole responsibility of the client.

Credit Card:           We accept payment by Visa or Mastercard. Please note, payment made by Visa or Mastercard may incur additional fees.

Amending or changing your tour   You may change the dates of your tour at any time (subject to availability of the specific components), however any third party costs, such as hotel amendment fees or cancellation costs will be payable by you. Please also bear in mind that amending the dates may alter the cost. NOTE: Amending the entire tour to alternate dates inside 14 days of arrival of the original confirmed tour will incur a fee of NZ$250 plus any cancellation or third party fees or price increases.

Our Accommodation and Activities Rights: Occasionally Carrington Tours New Zealand may need to amend or make a variation to the listed accommodation or activity. that is beyond our control, some services and products may be replaced.  Carrington Tours New Zealand guarantees that the replacement will be of equal or higher quality.

Any information provided is done so with the understanding that the information may have been provided by a third party and should therefore only be used as a guideline. Carrington Tours New Zealand may use third party suppliers or providers of some services and products and as such acts as agents for those suppliers. Any claim or liability resulting from those services or products is the responsibility of the supplier or provider.

Carrington Tours New Zealand, its employees, independent contractors, suppliers and any person acting on behalf of Carrington Tours New Zealand accept no responsibility for damage or loss to property or person howsoever caused.

Prices:                        All holiday prices are based on schedules, fares and tariffs current at the time of quotation. Carrington Tours New Zealand reserves the right to vary the cost of tours if necessary, by reason of currency fluctuation, or component cost increase. Tour costing will be guaranteed at the price prevailing at the date of final payment. This website contains price information. The price advertised may not be the same price charged to the credit card account due to exchange rate fluctuations. This means that because we are based in New Zealand, we have to convert your purchase to New Zealand dollars at the exchange rate on the day it is processed. So if you purchase on this website, you will always be charged the equivalent in New Zealand dollars at the bank exchange rate of the day.

Luggage Limits:      Suitcases will be stored in the secure luggage compartment and will be accessible during the day if in Luxury Sedan or Limousine. If in a Luxury Van the trailer luggage compartment will be accessible twice during the day if necessary. Please bring a soft bag, backpack or small day pack that can be easily stowed in the car, limousine or van for your rain jacket, sunhat, camera, snacks, medicines and other necessary items.

Room & Dietary Requests: Special room and dietary requests will be accepted and passed on to the hotels and included meal suppliers but cannot be guaranteed.

Smoking Laws:         Smoking is not permitted in any licensed premises (bars, restaurants, cafes, casinos, etc) throughout New Zealand. Smoking rooms at hotels will be subject to availability and may not be available in some destinations.

Seat Rotation:           For the enjoyment of all passengers Carrington Tours New Zealand operates a daily seat rotation system which all passengers must participate in as a condition of booking.

Travel Insurance:    Travel Insurance is not included and is strongly recommended for all travelers. We recommend you seek local and professional advice on your specific insurance needs at the time you make your reservation. Many insurance providers can include cancellation or interruption cover. This means that should your flight be delayed or cancelled or you need to amend your plans due to illness or other unforeseen circumstances then fees imposed by us or our suppliers may be recoverable. Check with your insurance provider and ask the question. It is your responsibility to ensure you are adequately covered.

Health, Fitness and Behaviour: Payment of the deposit by the client(s) to Carrington Tours New Zealand acts as a warranty that the client(s) is/are reasonably healthy and/or fit to participate in the tour and the client(s) indemnifies Carrington Tours New Zealand from all actions, claims and demands arising out of any want of health and fitness. Carrington Tours New Zealand reserves the right to remove a client from a tour if their health, fitness or behavior interfere with the tour or other client(s) tour experience in any way.

Responsibilities:        Carrington Tours New Zealand advises that the service it provides is for the booking and packaging of goods and services provided by other operators such as hotels, attractions and transportation companies. Travellers are advised to familiarise themselves with the terms and conditions on which these services are supplied. Accordingly Carrington Tours will not be responsible and will be excluded from liability for any loss, damage, omission or acts being negligent or otherwise, committed by the operators of airlines, coach lines, cruise vessels, hotels or attractions used in connection with the tours

Liability:                        The safety of Carrington Tours New Zealand clients is of paramount importance to it. Accordingly, Carrington Limousines Ltd endeavours to ensure that each activity it is involved with (whether it undertakes the activity directly or the activity is undertaken by a third party) is undertaken within strict safety guidelines. However, given that participation in a number of activities involves a degree of risk, Carrington Tours New Zealand does not in any way guarantee the safety of those participating in any particular activity and expressly excludes all liability howsoever arising in relation to the personal injury of any such participant or the loss of or damage to any property of any such participant or third party. Carrington Tours New Zealand  reserves the right to cancel any activity due to weather conditions, safety risks or client unsuitability because of age, ill health, poor fitness or intoxication etc. Carrington Tours New Zealand reserves the right to add, amend or delete activities where necessary.

Optional Tours:             Carrington Tours New Zealand does not operate these excursions. As such, no person employed or associated with Carrington Tours New Zealand has any connection with the operators of these excursions. Accordingly, Carrington Tours New Zealand cannot and do not take any responsibility for any injury, action, loss or damage of any type, arising in any manner from these excursions.

Dispute:                             The law of this contract is the law of New Zealand.

Documentation:             The client(s) is/are responsible for the acquisition of passports and appropriate visas, where necessary. We recommend that such documents, as required by governments, are finalised at least six (6) weeks prior to the date of departure.

Transfers:                         Airport transfers in New Zealand are not included if travelers have pre or post tour accommodation booked outside the Tour Hotels.

Holiday Duration:          The first and last day of most structured holidays is considered a travelling day and therefore depending on flight times may not necessarily be a whole day.

Force Majeure:                Except where otherwise expressly stated in these booking conditions we regret that we cannot accept liability or pay any compensation where the performance of our contractual obligations is prevented or affected by reason of circumstances amounting to “force majeure”. In these booking conditions, ‘force majeure’ means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riots, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control.

Third party terms and conditions: The omission of a link or reference to terms and conditions for third parties does not imply that our terms and conditions supersede those. It is impractical to list all of our providers terms and conditions and on request we can supply or answer a specific question. At the time of reservation we will endeavor to provide you with any information we feel you should be aware of but it is ultimately your responsibility to ensure you are happy with these terms.

Honest, fair and reasonable: Carrington Tours New Zealand prides itself on operating with honest, fair and reasonable business practices and has been built on providing excellent service and product to its guests. Should you feel that the product or service you have experienced did not live up to our promise then please contact the managing director on (+64) 7 850 4494. All possible actions will be undertaken to rectify the situation to your satisfaction.

Statutory Protections under New Zealand Law :These terms and conditions should be read subject to and in conjunction with the provisions of the Consumer Guarantees Act and the Fair Trading Act (applicable in New Zealand) and do not affect your rights as expressed in these acts.

A travel agent or other third party may have their own cancellation policy and if the reservation was made through such a third party you may be liable for additional cancellation costs. Please check when you make your reservation through a travel agent or third party.

Payments – Payments can be made by Direct Credit, Personal Cheque, Cash, and major Credit Cards

Deposit – Carrington Limousines Ltd require a deposit of 30% of the total amount at the time of your reservation to confirm booking.

Full payment – is required two weeks prior to your reservation.

All prices – are inclusive of GST and subject to change, at any time.

Direct Deposit – once booking has been made a secure email will be sent confirming dates and vehicles with our bank account details.

Credit Cards – once booking has been made a secure email will be sent confirming dates and vehicles with our bank account details.

Cash – Cash will be accepted as a deposit or to pay a balance, if you are making a payment with cash please make an appointment with the Staff at Carrington Limousines Ltd to arrange a time to meet before your booking.

Personal Cheques – All personal cheques must be received at least a minimum of 17 working days prior to your booking date. If we receive it less than 17 working days we will contact you to advise that we will need another form of payment and your cheque will be returned to you.

Out of area surcharge – An extra charge of $1.50 per km will apply to all bookings outside the greater Hamilton area in order to cover travelling costs (unless a total agreed price has been given).

Over Time – The hirer expressly agrees to pay immediately, or make arrangements to pay for any extended time periods over the initial requested time, charged in fifteen minute intervals based on the hourly rate already quoted at the time of booking. Over time is not always available so consider carefully how long you want the vehicle for. Should your car not be able to accommodate extended time the chauffeur will advise and shall depart at the time required to fulfil any other commitments that may be in place.

No shows – will incur a 100% fee.

Cancellations – Should you cancel your booking then a refund will be provided as follows:
A: Within 48hrs of the booking date, no refund.
B: Between 48hrs and 7 days from the booking date, a 50% refund, less a $30.00 booking fee.
C: Between 8 and 28 days from the booking date, a 75% refund, less a $30.00 booking fee.
D: Over 28 days before the booking date, a 100% refund, less a $30.00 booking fee.
Should we obtain an alternative booking for that date, following your cancellation, then a full refund of your deposit, minus the $30 booking fee regardless of the cancellation period will be made to you.

Surcharge – A 20% surcharge will apply on Statutory Holidays.

Personal Items – Carrington Limousines Ltd do not take any responsibility for any personal items held by the passenger or any item left in the vehicle during or after completion of this service.

Passengers – We take Health and Safety very seriously and only the number of passengers for which the car has been licensed will be carried. Where seat belts are fitted, it is the responsibility of the passengers to use them.

Unforseen Delays – Carrington Limousines Ltd hold no responsibility for delays caused by but not limited to traffic delays, breakdown, detours, delays, incorrect information, acts of nature or any situation beyond our control.

Smoking – Smoking of any substances will not be permitted in any  vehicles. Immediate termination of contract will be applied.

Alcohol – Possession, sale or consumption of any type of illegal drug or unauthorized alcohol is not permitted. Alcohol is not permitted in vehicles where passengers are under the age of 18. Strictly no alcohol will be allowed for transfers for school balls.

Food – Please note some foods will not be allowed in our Limousines, please check with us should you choose to bring food on board prior to your booking. Drinking and eating is at the sole discretion of the chauffeur.

Vehicles – Our vehicles are groomed thoroughly prior to hire, but no liability can be accepted for clothing stained or marked by road grime, oil or grease, however unlikely this may be, from any part of the vehicle.

Standard Transfer – A one way transfers is a direct pick up and drop off and does not include multiple pick-ups.

Airport Transfer – All our Drivers will meet and greet client upon airport arrival with your name on a white board , and help you out with your luggage . If you can’t locate the driver please do not leave and call the office on 07 850 4494 or 0220 706686.

Airport pickups – additional charges may incur for waiting time for arriving flights the first 15mins of delay is included in the agreed fee an additional $30.00 for every 30mins waiting time will apply.

Pick ups – waiting time from private home , businesses, hotels or venues, first 10 minutes are free of charge , then $1.00 per minute thereafter

Interruption – If an interruption occurs after the commencement of the hire, we will do everything we can to get you to the required destination on time, no compensation will be made or paid and no liability will be accepted by the company for any consequential loss or disappointment.

Specials – all specials run for a 3 month period and are to be redeemed within this period, quarterly periods Jan/March  April/June  July/Sep  Oct/Dec  unless stated otherwise.

Underage Bookings – If Limousine rental is made by a person under 18yrs, payment of booking acknowledges terms and conditions have been read understood and accepted by a parent or guardian. All children must be supervised by a responsible adult at all times.

Exclusion of Liability – The client and their respective guests shall not have any claim of any nature whatsoever against Carrington Limousine Ltd for any loss, damage or injury which the client and their guests may directly or indirectly suffer. (whether or not such loss, damage or injury is caused through the negligence of the company or its servants or employees) by reason of any accident in which the vehicle may be involved or theft of the vehicle or theft of any article or item from the vehicle, or any act of omission by the company or its servants or employees arising in any manner whatsoever out of the use of the vehicle or the conveyance of the client and his/her co-passengers in the vehicle for any purpose whatsoever
The client shall under no circumstances whatsoever have any claim against The Company for consequential loss, howsoever caused.

Vehicle Replacement – We do our very best to replace vehicles that are not able to complete a job due to unexpected breakdowns, acts of nature and any situations beyond our control. We reserve the right to substitute alternative vehicles in the event of an occurrence beyond our control.

Hirers Responsibility – The person and or company reserving the vehicle are responsible for all guests and any damage to the interior and exterior by wilful damage to the chattels and fixtures of the said vehicle. All passengers agree to behave in an orderly and well- behaved manner. This is including but not limit to: liquid spillage, soiling, breakage of glassware, all electrical and electronic components. Repair and replacement of items hold a minimum charge of $400.00. Carrington Limousines Ltd reserves the right to expel any person from the said vehicle and /or terminate this contract in the event of violation of any of the above conditions by any passenger. In the event of such early termination all of any fees paid shall be forfeited.

Licenses – Our vehicles are fully licensed as Passenger Service Vehicles, hold current Certificates of Fitness, are fully insured and will be driven only by Qualified Passenger Service endorsed chauffeurs.

In the event any part of this agreement is unenforceable, the remaining conditions of this agreement shall remain in full force and effect. We reserve the right to cancel your reservation if we have not received final payment prior to your booking.

Failure by you, to read and understand these terms and conditions does not absolve our right to enforce them.

Deposit – Carrington Limousines Ltd require a deposit of 30% of the total amount at the time of your reservation to confirm booking.

Full payment – is required two weeks prior to your reservation.

All prices – are inclusive of GST and subject to change, at any time.

Direct Deposit – once booking has been made a secure email will be sent confirming dates and vehicles with our bank account details.

Credit Cards – once booking has been made a secure email will be sent confirming dates and vehicles with our bank account details.

Cash – Cash will be accepted as a deposit or to pay a balance, if you are making a payment with cash please make an appointment with the Staff at Carrington Limousines Ltd to arrange a time to meet before your booking.

Personal Cheques – All personal cheques must be received at least a minimum of 17 working days prior to your booking date. If we receive it less than 17 working days we will contact you to advise that we will need another form of payment and your cheque will be returned to you.

Out of area surcharge – An extra charge of $1.50 per km will apply to all bookings outside the greater Hamilton area in order to cover travelling costs (unless a total agreed price has been given).

Over Time – The hirer expressly agrees to pay immediately, or make arrangements to pay for any extended time periods over the initial requested time, charged in fifteen minute intervals based on the hourly rate already quoted at the time of booking. Over time is not always available so consider carefully how long you want the vehicle for. Should your car not be able to accommodate extended time the chauffeur will advise and shall depart at the time required to fulfil any other commitments that may be in place.

No shows – will incur a 100% fee.

Cancellations – Should you cancel your booking then a refund will be provided as follows:
A: Within 48hrs of the booking date, no refund.
B: Between 48hrs and 7 days from the booking date, a 50% refund, less a $30.00 booking fee.
C: Between 8 and 28 days from the booking date, a 75% refund, less a $30.00 booking fee.
D: Over 28 days before the booking date, a 100% refund, less a $30.00 booking fee.
Should we obtain an alternative booking for that date, following your cancellation, then a full refund of your deposit, minus the $30 booking fee regardless of the cancellation period will be made to you.

Surcharge – A 20% surcharge will apply on Statutory Holidays.

Personal Items – Carrington Limousines Ltd do not take any responsibility for any personal items held by the passenger or any item left in the vehicle during or after completion of this service.

Passengers – We take Health and Safety very seriously and only the number of passengers for which the car has been licensed will be carried. Where seat belts are fitted, it is the responsibility of the passengers to use them.

Unforseen Delays – Carrington Limousines Ltd hold no responsibility for delays caused by but not limited to traffic delays, breakdown, detours, delays, incorrect information, acts of nature or any situation beyond our control.

Smoking – Smoking of any substances will not be permitted in any  vehicles. Immediate termination of contract will be applied.

Alcohol – Possession, sale or consumption of any type of illegal drug or unauthorized alcohol is not permitted. Alcohol is not permitted in vehicles where passengers are under the age of 18. Strictly no alcohol will be allowed for transfers for school balls.

Food – Please note some foods will not be allowed in our Limousines, please check with us should you choose to bring food on board prior to your booking. Drinking and eating is at the sole discretion of the chauffeur.

Vehicles – Our vehicles are groomed thoroughly prior to hire, but no liability can be accepted for clothing stained or marked by road grime, oil or grease, however unlikely this may be, from any part of the vehicle.

Standard Transfer – A one way transfers is a direct pick up and drop off and does not include multiple pick-ups.

Airport Transfer – All our Drivers will meet and greet client upon airport arrival with your name on a white board , and help you out with your luggage . If you can’t locate the driver please do not leave and call the office on 07 850 4494 or 0220 706686.

Airport pickups – additional charges may incur for waiting time for arriving flights the first 15mins of delay is included in the agreed fee an additional $30.00 for every 30mins waiting time will apply.

Pick ups – waiting time from private home , businesses, hotels or venues, first 10 minutes are free of charge , then $1.00 per minute thereafter

Interruption – If an interruption occurs after the commencement of the hire, we will do everything we can to get you to the required destination on time, no compensation will be made or paid and no liability will be accepted by the company for any consequential loss or disappointment.

Specials – all specials run for a 3 month period and are to be redeemed within this period, quarterly periods Jan/March  April/June  July/Sep  Oct/Dec  unless stated otherwise.

Underage Bookings – If Limousine rental is made by a person under 18yrs, payment of booking acknowledges terms and conditions have been read understood and accepted by a parent or guardian. All children must be supervised by a responsible adult at all times.

Exclusion of Liability – The client and their respective guests shall not have any claim of any nature whatsoever against Carrington Limousine Ltd for any loss, damage or injury which the client and their guests may directly or indirectly suffer. (whether or not such loss, damage or injury is caused through the negligence of the company or its servants or employees) by reason of any accident in which the vehicle may be involved or theft of the vehicle or theft of any article or item from the vehicle, or any act of omission by the company or its servants or employees arising in any manner whatsoever out of the use of the vehicle or the conveyance of the client and his/her co-passengers in the vehicle for any purpose whatsoever
